Terms of Service

These Terms of Service ("Terms") are an agreement between you and Grailology, LLC ("Grailology," "we," "us"), a California limited liability company, and govern your use of the website at grailology.com, including the community grading quiz (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. What the Services are (and aren't — yet)

Grailology is building an open standard for the authentication and grading of collectible cards. The Services currently consist of an informational pre-launch website and a community grading quiz in which participants grade photographs of real cards to help calibrate an open grading algorithm. The Services do not currently include any purchase, sale, grading submission, or other commercial offering. If and when commercial services launch, they will be governed by additional or updated terms presented at that time.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian.

3. Your account

Parts of the Services (such as saving quiz progress) require verifying an email address. You agree to provide accurate information, to use an email address you control, and not to impersonate anyone else. One person, one account: the quiz is designed around one voice per grader, and we may remove duplicate or automated accounts.

4. Community contributions

When you submit grades, judgments, or other responses through the quiz (collectively, "Contributions"), you grant Grailology a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, analyze, adapt, aggregate, and publish your Contributions — including as part of published datasets, statistics, and the calibration of grading algorithms. Published outputs are aggregated or anonymized; we will not publish your email address. You represent that your Contributions are your own honest judgments.

5. Acceptable use

You agree not to: (a) access the Services with bots, scrapers, or other automated means (except ordinary search-engine indexing); (b) interfere with or disrupt the Services; (c) attempt to gain unauthorized access to any systems or data; (d) submit deliberately false or manipulative quiz responses at scale; or (e) use the Services in violation of any applicable law.

6. Intellectual property

The Services — including text, design, imagery, data, and software — are owned by Grailology or its licensors and protected by intellectual-property laws. Except for the limited right to use the Services as intended, no rights are granted to you. Card names, set names, and related marks that may appear in card photographs belong to their respective owners; their appearance is for identification and does not imply affiliation or endorsement.

7. Third-party services

The Services run on third-party infrastructure (including Cloudflare) and use third-party tools such as Cloudflare Turnstile for bot protection and Resend for email delivery. Your use of the Services is also subject to any terms those providers impose on end users.

8. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Quiz content, crowd statistics, and algorithm outputs are experimental and informational only — they are not professional grading, authentication, valuation, or investment advice, and you should not rely on them for buying, selling, or valuing cards.

9. Limitation of liability

To the maximum extent permitted by law, Grailology will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to the Services. To the maximum extent permitted by law, Grailology's total liability for all claims relating to the Services will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including for violation of these Terms. Sections 4, 6, 8, 9, and 11–12 survive termination.

11. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted at this page with its effective date. Material changes will be reasonably highlighted (for example, a notice on the site). Continued use of the Services after changes take effect constitutes acceptance.

12. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Services will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction.
